This Sweepstakes is sponsored by the Hass Avocado Board (the “Sponsor”), with offices located at 25212 Marguerite Pkwy. Suite 250, Mission Viejo, CA 92692

I. SWEEPSTAKES PERIOD: The Avocado Tips Sweepstakes (“Sweepstakes” or “Promotion”) begins 12:00 a.m. Eastern Standard Time (“EST”), July 22, 2024 (“Start Date”), and ends 11:59 p.m. EST November 30, 2024 (“End Date) (collectively the “Sweepstakes Entry Period” or “Sweepstakes Period”). One (1) winner will be selected randomly by entering their full names and email addresses. Participation constitutes a participant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding on all matters related to the Sweepstakes. This Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with any social platform.

II. ELIGIBILITY: The Sweepstakes is open to U.S. citizens or legal residents of the fifty (50) United States and the District of Columbia (“D.C.”) who are eighteen (18) years of age at time of entry. To participate in the Sweepstakes, an individual must have Internet access. Board members and employees (full-time or part-time) of the Sponsor, and any of their respective parent companies, affiliated companies, subsidiaries, dealers, franchisees, licensees, distributors, suppliers, subsidiaries, participating retailers, advertising / promotion / judging agencies, persons engaged in the development, production or distribution of materials for this Sweepstakes (collectively, the “Released Entities”) and the immediate family members, which includes spouses, sibling, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Participation constitutes Participant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, and where prohibited, taxed, or restricted by law.

III. HOW TO PARTICIPATE IN THE SWEEPSTAKES: An individual will be deemed a participant (“Entrant” “Subscriber” or “you”) in the Sweepstakes if eligible and enters the Sweepstakes via the following one (1) Method of Entry:

Avocados – Love One Today® Avocado 101 QR Code Method of Entry: Scan the QR code on the Avocados – Love One Today® Avocado 101 handout provided in a healthcare professional office to visit https://LoveOneToday.com/preptips (the “Website”) and complete the Entry Form (“Entry Form”) for free Sweepstakes. You are required to provide: first name and valid e-mail address. Upon completion of the form, each Subscriber (“Subscriber(s)”) automatically receives one (1) Entry (“Entry(ies)”) into the Sweepstakes.
Limit: One (1) Entry per Entrant or Subscriber during the Promotion Period regardless of method of Entry. All required information must be completed to enter and to be eligible to win. Incomplete entries will be disqualified. Internet Entries must be made by the Participant only at the aforementioned Website and application URL addresses. Entries made by any other individual or any entity, and/or originating at any other web site or e-mail address, including, but not limited to, commercial Sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes. Sponsor reserves the right, in its sole discretion, to void any and all Entries of a Participant that submits more than the stated maximum limit of Entries by using multiple/different addresses, identities, or any other methods, or who Sponsor believes has attempted to tamper with, influence or impair the administration, security, fairness, or proper play of this Sweepstakes. Proof of entering information is not considered proof of delivery to or receipt by Sponsor of an Entry. The use of automated Entry devices is prohibited, and no mechanically reproduced Entries are allowed; all such Entries are void. Released Parties are not responsible for: lost, late, incomplete, illegible, incorrect, damaged, delayed, garbled, undelivered, or misdirected Entries, will be disqualified. All Entries become the exclusive property of Sponsor and will not be acknowledged or returned.

If a Participant opts to enter via his/her wireless mobile device (which may only be available via participating wireless carriers and is not required to enter the Sweepstakes), standard text messaging and/or data rates may apply for each message sent or received from your handset according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers’ rate plans may vary, and you should contact your wireless carrier for more information on messaging rate plans and charges relating to your participation in this Sweepstakes. Participation in this Sweepstakes by mobile device means that you understand that you may receive additional messages by mobile device relating to this Sweepstakes, which may be subject to charges pursuant to your carrier’s rate plan. Text messaging may not be available from all mobile phone service carriers and handset models. Mobile device service may not be available in all areas. Check your phones capabilities for specific instructions.

IV. WINNERS DETERMINATION AND ODDS: One (1) Winner (“Winner”) will be selected from among all eligible Entries received, in a random drawing on or about December 6, 2024 by the Hass Avocado Board (“the Administrator”), whose decisions are final in all matters relating to this Sweepstakes. Potential Winner will be notified by e-mail. If the potential Winner does not respond within two (2) calendar days of the initial notification, or does not respond with complete contact information as requested by email, or found to be ineligible, cannot or does not comply with these Official Rules, or if his/her prize or prize notification is returned as undeliverable, such potential Winner will be disqualified and an alternate potential Winner may be selected at Sponsor’s sole discretion. The odds of winning are determined by the number of entries.

WINNER SELECTION AND NOTIFICATION SCHEDULE

One (1) Grand Prize Winner will receive a $500 Visa® gift card.

VI. PRIZE TERMS AND CONDITIONS: All federal, state and local laws and regulations apply. The value of the Grand Prize may be taxable as income and the potential Winners are solely responsible for all matters relating to the Prizes, including, but not limited to all applicable federal, state and local taxes that become due with respect to the Prizes.

A Winner is not eligible to receive a Prize until verified in accordance with these Official Rules, and the Winner has fully complied with these Official Rules. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. A Grand Prize Winner’s acceptance of the Prize offered constitutes permission (except where prohibited) for the Sponsor to use said Winner’s name in all forms of media, in perpetuity, without notice or further compensation. The winner agrees to be bound by these Official Rules and by the decisions of the Sponsor, which are final and binding in all respects.

VII. LIMITATIONS OF LIABLILTY: Sponsor reserves the right in its sole discretion to terminate, modify or suspend the Promotion in whole or in part because of any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications, equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Promotion by any party, or any federal, state, local or provincial government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsors’ control (each a “Force Majeure” event or occurrence).
Sponsors also reserve the right, in their sole and absolute discretion: (a) to modify, suspend or terminate the Promotion should causes beyond Sponsors’ control corrupt or interfere with the administration, integrity, operation, security or proper play of the Promotion; or (b) to disqualify any Participant found to be, or suspected of: (i) tampering with the Entry process or the operation of the Promotion; (ii) acting in violation of these Official Rules; or (iii) acting in an un-sportsmanlike manner. If for any reason, this Promotion is not capable of running as planned due to infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor, which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Sponsor reserve the right, at their sole discretion, to disqualify any individual who tampers with the Entry process (if applicable), and to cancel, terminate, modify or suspend the Promotion, in whole or in part, at any time, without notice and award the Prize using all non-suspect eligible Entries received as of the termination/suspension date. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries. The Sponsor also is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure or delay of any e-mail or submission to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof. Sponsor is not responsible for any damage to a Promotion’s system, which is occasioned by participating in this Promotion or by downloading any information necessary to participate in the Promotion. Sponsor is also not responsible for incorrect or inaccurate Entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Promotion or by any technical or human error, which may occur in the processing of the Entries in the Promotion. If any provisions of the Official Rules are determined by a court of competent jurisdiction to be invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision. CAUTION: ANY ATTEMPT TO DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE; THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning Entry will be declared made by the authorized account holder of the e-mail address submitted at time of Entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

VIII. PRIVACY / OPT-IN: By entering the Sweepstakes, you hereby authorize the Sponsor the right to collect, use, process, transfer and store all data provided by you, including without limitation, personal data, that the Sponsor deems necessary. All information submitted to the Sponsor as part of this Sweepstakes will be treated in accordance with the privacy policy, available at https://LoveOneToday.com/privacy-policy/.

IX. RELEASES: All Participants, as a condition of participation in the Sweepstakes, agree to indemnify, release and hold harmless Released Entities from and all liability, claims, damages, injuries or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with: (a) participating in any aspect of the Sweepstakes; or (b) the receipt, ownership, possession, use or misuse of any Prize awarded.

X. GOVERNING LAW/DISPUTES: Except where prohibited, as a condition of participating in this Sweepstakes, Participants agree that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of, or connected with this Sweepstakes, or any prizes awarded, or the determination of Winner shall be resolved individually (without resort to any form of class action and with the understanding and agreement that these Official Sweepstakes Rules shall apply), and shall be submitted to arbitration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective. Further, in any such dispute, under no circumstances will Participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Participant’s actual out-of-pocket expenses (e.g., costs associated with entering this Sweepstakes), and Participant further waives all rights to have damages multiplied or increased. The arbitration shall be conducted in the State of California, in the City of Mission Viejo, County of Orange, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. In the event that arbitration is prohibited, in a particular state/territory then any such claim shall be brought and maintained in the federal or state courts of the State of California, in the City of Mission Viejo, County of Orange. Any dispute or claim arising out of the entry of this Sweepstakes, or any disputes with site users which arise as a result of the use of this website, shall be governed by the laws of the State of California, without respect to conflicts of laws principles.

WINNERS LIST/OFFICIAL RULES REQUEST: For the names and city/state of residence of the prize winners or a copy of these Official Rules send a self-addressed, stamped envelope postmarked by 2/21/25 and received by 2/28/25 specifying Winners List or Official Rules request to: Hass Avocado Board/Food Is Medicine Winners List, 25212 Marguerite Pkwy.
